MAKE Southwest Competitions Terms and Conditions
These terms and conditions relate to the requirements of the Gambling Act 2005 & December 2009
1. Wherein: Prize competitions and free draws are free of statutory regulatory control under the Gambling Act 2005. Such competitions and draws can therefore be organised commercially for private benefit and profit. This contrasts with public lotteries, which are the preserve of good causes, and must, unless they qualify in one of the ‘exempt’ categories, operate under a licence issued by the Gambling Commission (the Commission). Lottery operating licences are only issued to non-commercial societies and external lottery managers who promote lotteries on their behalf.
2. MAKE Southwest (formerly Devon Guild of Craftsmen) as organisers of competitions and free draws are aware that although they fall outside the ambit of the Gambling Act, we are considerate of the other rules and regulations in place when developing and running their scheme.
3. MAKE Southwest d runs gallery prize competitions, where you do not pay to enter and where success depends, at least in part, on the exercise of skill, judgement or knowledge by the participants. This distinguishes them from lotteries, where entry demands payment - and either success depends wholly on chance or, in a complex lottery, the first stage relies wholly on chance.
4. MAKE Southewest will be able, upon request to produce evidence that the skill, knowledge or judgement element eliminated a significant proportion of either actual or potential entrants, in order to select a prize winner.
GALLERY COMPETITION
1. Terms and conditions
i. Entries received after the close of the exhibition will not be considered.
ii. All entries will be judged by a fair process of viewing and consultation.
iii. All under 12 yrs winning entries can only be ID’d by contact with the named the parent or guardian.
iv. Winners will be chosen and contacted no later than the named date.
v. Winners may be from within and outside the UK and EU.
vi. All data will be held securely by MAKE Southwest, and will be treated confidentially, securely locked/encrypted until deleted, will not be given away or sold to any 3rd parties and not kept for longer than is necessary for that purpose.
vii. Prize winners’ names and winning pieces may be used for limited time only in MAKE Southwest promotional material such as selected social media and subscribed e-news bulletins or newsletters - or the website only after permission is requested and granted by the winner themselves/parent guardian of winner.
viii. Names of winners can be supplied on written request by the public or Gambling Commisison after the draw date only in reference to a challenge relating to a breach of the Gambling Act.
2. Acknowledgement and Terms
MAKE Southwest accepts responsibility for the lawful operation of the promotion, including the official rules (see above), terms and eligibility requirements (e.g., age and residency restrictions.), and compliance with regulations governing the promotion and all prizes offered in connection with the promotion (e.g., entry and obtaining necessary regulatory approvals – see above).
